No, <OL> is valid.

OL is legal w/in the following tags:
BLOCKQUOTE, BODY, BUTTON, CENTER, DD, DIV, FIELDSET, FORM, IFRAME, LI,
NOFRAMES, NOSCRIPT, OBJECT, TD, TH

You can use the following tags w/ in OL ... /OL:
<LI>
