fieldset element

On a page I am working on I have used the tags:

 <.fieldset>
            <.legend>a caption<./legend>
                some text links some text
<./fieldset>

in order to make a nicely captioned border around a group of links. My
reference material says these elements are only to be used inside a FORM,
and after looking at the w3c specifications I see that's how it is intended.
But the page still validates without the FORM and it seems to degrade nicely
in Netscape.

Has anyone else used the fieldset element and gotten unfavorable results? Is
it just not frequently seen because it's not supported by NN? Do you see
other possible drawbacks that I have missed?
