I know of a client that did this.  I was a supporting witness through an
affidavit.  She won the case in small claims court and the client was then
ordered to pay the original cost of her work.  I think that if you preferred
to simply get the copyrighted work back instead of payment, that it would
probably be up to you (although the judge may give the client the option of
paying or turning things over).

That may be a good route to go.  That way, if you win the case, the
defendant will have to pay the court cost.  It would only cost you about a
$20 or $30 filing fee that gets reimbursed by the defendant if you win.
(Filing costs vary from county to county).
