Site take over from volunteer

Hi List -

I've been asked to take over a site for a company.
Their site was designed and has been maintained by
a "consumer/volunteer" of this company's product - for free.

The "consumer/volunteer" lives in a different country and the site owner
has experienced difficulty in getting the "consumer/volunteer" to answer
e-mail
and do the updates promised.

I will be given ftp access and the "consumer/volunteer" will be cut off.
The site owner has some very time-sensitive updates
that must be made to coincide with direct mail pieces.

What rights does the "consumer/volunteer" have?
What rights does the site owner have?

I'd like to get the job, but might it be better to do
a new redesign? The site looks great for the target
market and it is technically sound.

My head tells me that I should advise the site owner to
do a complete redo, but if they have rights to
the site, then they should not have to shell
out the expense.

Any comments? Words of caution?
