What am I missing here ?
Why is the site designer concerned with any of this stuff ?
If the client is asking the designer to advise him on these issues - point the client to 
whatever division of his government is concerned with this issue, and stay out of it.

There are a multitude of sites in the USA selling tobacco products. Some do ask for age 
verification. Those that are not run by Native Americans on Indian reservation property 
charge the full price less a small discount and include taxes and shipping.
The value of the site is that they carry International and hard to find brands that may 
not be available to you locally - and of course, the product is delivered to your door.

You have a right to make your ethics known, so if you don't feel that tobacco in any form 
should be made available to anyone at any time for any reason, tell that to the client 
and say goodbye.  

I'm all for a firm moral stand - unless of course you need the money :-)
