I always thought ascii went up to 255, but I suppose you're right.
Personally, I use the actual (tm) character by holding down ALT and typing
0153 on the numeric pad, then releasing the ALT. &#0153; does work in IE and
NN, however. In addition, there is a Unicode number that works too.

What I have found NOT to work consistently is &trade;.

  IMHO  153 is not ASCII code for anything because ASCII codes end up on 127

  153 is the code for TM in Windows character set which is kind
  of illegal in the Internet.  W3C validator warns you if you
  try to use characters within 128 to 159 range.
